JAKARTA - Penyidik senior Komisi Pemberantasan Korupsi (KPK) Novel Baswedan kembali mendapat ''serangan''. Setelah Direktur Penyidikan KPK Brigjen Aris Budiman melaporkan Novel ke polisi, kini giliran Wadir Tipikor Bareskrim Polri Kombespol Erwanto Kurniadi melakukan langkah serupa. Erwanto melaporkan Novel pada Selasa lalu (5/9) terkait pernyataannya di salah satu media cetak.
Kabidhumas Polda Metro Jaya Kombespol Argo Yuwono menuturkan statemen Novel yang diperkarakan itu dikutip dari salah satu media edisi 3-9 April 2017. Dalam kutipan itu, Novel menyebutkan penyidik Polri yang pernah bertugas di KPK berintegritas rendah. ”Pak Erwanto yang pernah bekerja di KPK merasa keberatan dengan statemen tersebut. Akhirnya melapor ke polisi," terang Argo kemarin.
Novel disangkakan dengan pasal 310 dan 311 KUHP tentang pencemaran nama baik. Ancaman hukuman pasal 310 paling lama 9 bulan. Sedangkan untuk pasal 311 KUHP maksimal empat tahun. Polisi tidak hanya menerima laporan dari Erwanto. Di sentra pelayanan kepolisian terpadu (SPKT) Polda Metro Jaya juga masuk dua laporan anyar dari Dirdik KPK Brigjen Aris Budiman.
Laporan pertama bernomor LP 4220/IX/PMJ itu terkait pemberitaan di media cetak. Kemudian kedua, dengan nomor LP 4219/IX/PMJ terkait berita di stasiun televisi. ”Kedua laporan tersebut terkait kasus e-KTP,” tambah Argo. Menurut dia, kepolisian tengah memproses kasus tersebut. Tahapan pertama yakni penyelidikan. Polisi mencari tahu apakah ada unsur pidana dari dua pelaporan itu. Jika ada unsur pidana, polisi bakal melanjutkan ke tahap penyidikan.
Dirkrimsus Polda Metro Jaya Kombespol Adi Deriyan menyebutkan, pihaknya memeriksa dua penyidik KPK dan seorang Kepala Biro Hukum KPK sebagai saksi. Hanya, Adi tidak menyebutkan nama para saksi tersebut. "Kepala biro hanya mendampingi. Polisi hanya memeriksa dua penyidik KPK," terang dia saat dihubungi Jawa Pos.
Sementara itu, Kombespol Erwanto Kurniadi belum bisa berkomentar banyak terkait laporannya tersebut. ”Saya belum bisa, kalau sekarang muncul nanti pernyataan saya dipelajari,” terangnya saat dihubungi Jawa Pos.
Kabareskrim Komjen Ari Dono Sukmanto mengatakan bahwa laporan Wadir Tipikor tersebut merupakan hak pribadinya. Apakah merasa tersinggung atau lain sebagainya. ”Itu urusan pribadi masing-masing,” ujarnya. Secara kelembagaan hubungan antara Polri dengan KPK sangat bagus. Misalnya kalau Bareskrim punya target, namun karena kemampuan terbatas kasus itu dialihkan ke KPK. Banyak kasus yang sudah dilimpahkan Bareskrim ke KPK. ”Direktorat Tindak Pidana Korupsi sering berikan kasus ke KPK,” tambahnya.
Di sisi lain, Novel tetap tenang menyikapi “serangan” mantan rekan satu korpsnya itu. Menurut dia, pelaporan tersebut justru bisa memperburuk citra kepolisian saat ini. ”Saya belum tahu isi laporannya apa,” ujarnya saat dikonfirmasi melalui nomor pribadi Taufik Baswedan, kakak kandungnya.
Secara umum, Novel mempertanyakan ucapan mana yang diperkarakan Erwanto. Begitu pula terkait siapa yang merasa nama baiknya tercemar. Novel pun menilai kasus yang dilaporkan itu masih belum jelas. ”Kalau (pernyataan yang dipersoalkan terjadi 3-9 April, Red) berarti sebelum penyiraman air keras dong,” imbuh ketua Wadah Pegawai KPK ini.
Juru Bicara KPK Febri Diansyah menambahkan, pihaknya bakal berkoordinasi dengan Polri secara institusi untuk meredam masifnya pelaporan tersebut. Menurut dia, KPK-Polri harus bekerja sama dalam upaya pemberantasan korupsi. Sebab, musuh kedua institusi itu sejatinya adalah para penjahat, khususnya pelaku korupsi.
”Koordinasi akan kami lakukan sesegera mungkin secara langsung dan informal komunikasi antarpimpinan,” ungkapnya di gedung KPK kemarin (6/9). Selain berkoordinasi, pihaknya tetap akan memberikan pendampingan atau bantuan hukum terhadap Novel. Itu diatur dalam peraturan internal KPK. ”Itu prinsip paling dasar,” sahutnya.
Pendampingan itu secara khusus akan dilakukan tim biro hukum KPK. Saat ini, biro hukum dipimpin Kombespol Setiadi yang merupakan perwira aktif kepolisian. Terkait netralitas kabiro hukum dalam pendampingan untuk Novel, komisi antirasuah memastikan tidak ada masalah dengan latar belakang yang bersangkutan.
”Keputusan tentu diambil dan diketahui melalui proses yang berjenjang sampai ke pimpinan,” kata Febri. Pegawai KPK berasal dari berbagai institusi. Mulai kepolisian, kejaksaan, hingga PNS kementerian. Febri memastikan, perbedaan asal-usul itu tidak menjadi masalah di internal KPK. ”Di biro hukum sendiri ada bagian lagi yang mengurus mitigasi, dan ada tim disana,” imbuhnya.
Terkait penanganan dugaan pelanggaran etik yang dilakukan Aris Budiman, Febri mengatakan hasil telaah direktorat pengawasan internal sudah selesai. Hasilnya pun sudah disampaikan ke pimpinan. Hanya, sampai sekarang hasil itu belum bisa dipublikasikan. ”Saat ini pimpinan sedang mempelajari telaah tersebut,” paparnya.
